Terms of Service
1. The agreement
These Terms of Service ("Terms") are an agreement between you and Mebot AI Corp, a Delaware corporation ("Mebot", "we", "us") and govern your use of Mebot Selfware, the www.mebot.ai website and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service for an organisation, you agree for that organisation and confirm you have authority to do so.
2. Who can use Mebot
You must be at least 18 years old and able to form a binding contract. Access is currently by invitation from our waitlist, and we may decide who gets access. Keep your sign-in details secure. You are responsible for activity under your account and for telling us promptly at support@mebot.ai if you suspect someone else has used it.
3. The Service
Mebot builds an AI representation of you (your "Mebot") from the content you provide, and lets it answer, talk, join meetings, make calls, send messages and take other actions for you, as you configure it. The Service is in early access. Features may change, be limited, or be removed, and some are experimental. We will try to give notice of changes that significantly reduce what you can do.
4. Your content
You own your content. "Your content" means what you upload, connect, say or type into the Service, and the profile and output generated from it for you.
You give Mebot a worldwide, non-exclusive, royalty-free licence to host, copy, process, transmit and display your content only as needed to provide, secure and support the Service for you, including through the subprocessors described on our subprocessor page, and to share it as you direct. This licence ends when your content is deleted, except for copies in backups until they expire and where the law requires us to keep them. We do not use your content to train AI models.
You are responsible for your content. You confirm that you have the rights and permissions needed to give it to us and to have it processed as these Terms describe. That includes content containing other people's personal information, such as meeting transcripts, messages and contact details. Where the law requires it, you are responsible for telling those people and getting their consent.
5. Your voice and likeness
- You may create an avatar or voice only of yourself, from photos, video and voice recordings of you that you have the right to use.
- You must not create an avatar or voice of anyone else, even with material you hold, unless we have agreed it in writing and that person has given their verifiable consent.
- You authorise Mebot and its avatar and voice providers to use your likeness and voice to generate audio and video of you for your Mebot, as you direct, while your account is open.
6. When your Mebot acts for you
Your Mebot speaks and acts on your behalf and on your instructions. You are responsible for what you tell it to do, for who you let it talk to, and for the calls, messages, meeting attendance, calendar changes and other actions you set it up to take. In particular:
- Calls and texts. Before your Mebot calls or texts anyone, you must have their consent where the law requires it. Calls and texts from a Mebot are made with an artificial voice and automated messages, which many laws (including the US Telephone Consumer Protection Act) regulate strictly. You must not use the Service for telemarketing, sales or solicitation calls or texts unless we have agreed it in writing. You must honour any request to stop contacting someone.
- Meetings. When you send a Mebot meeting bot, you are responsible for making sure the meeting's participants are told it is there and, where the law requires, agree to it recording or transcribing the meeting.
- Disclosure. Your Mebot tells people it is an AI acting for you. You must not remove or disguise that disclosure or tell your Mebot to claim it is a human.
7. Acceptable use
You must not use the Service to:
- impersonate any person or organisation, or mislead anyone about who they are dealing with;
- clone or imitate anyone's voice or likeness without their consent (section 5);
- make calls or send texts that break telemarketing, robocall, anti-spam, do-not-call or caller-ID laws;
- record, transcribe or monitor anyone where that is unlawful;
- make or support decisions about another person's eligibility for employment, credit, insurance, housing or similar, using the profiles of contacts the Service builds;
- harass, threaten, defraud or harm anyone, or collect information about people for surveillance;
- upload content you have no right to share, or content that is illegal, including child sexual abuse material;
- break any law or anyone else's rights, including privacy, intellectual property and publicity rights;
- interfere with or disrupt the Service, probe or bypass its security or limits, or access it other than through the interfaces we provide;
- use the Service, or its output, to build a competing product or to train AI models;
- resell or give others access to the Service, except through the sharing features it provides.
8. AI output
The Service uses AI models that can produce output that is inaccurate, incomplete, out of date or not what you would have said. Your Mebot may misremember, misunderstand or misrepresent you or others. Output is not professional advice (legal, medical, financial or otherwise). Review important output before relying on it, and do not use the Service where a mistake could cause death, injury or serious harm. You are responsible for how you, and people you share your Mebot with, use its output.
9. Third-party services
The Service works with services we don't control, such as Google Calendar, Slack, file storage services, video-meeting platforms and AI tools you connect. Your use of them is governed by their own terms. We are not responsible for them, and a change on their side may affect the Service.
10. Fees
Some features may need a paid plan or credits. Prices and what is included are shown before you buy. Payments are processed by our third-party payment processor. Unless the purchase screen says otherwise, fees are non-refundable except where the law requires, and subscriptions renew until cancelled. We may change prices for future periods with advance notice.
11. Suspension and termination
You can stop using the Service at any time and ask us to delete your account by emailing support@mebot.ai. We may suspend or end your access, or remove content, if you break these Terms, if your use creates risk or legal exposure for Mebot or others, or if we stop offering the Service. Where reasonable, we will tell you first and give you a chance to get a copy of your content. Sections 4 (licence for backups), 8, 12, 13, 14, 15 and 17 continue after termination.
12. Disclaimers
The Service is in early access and is provided "as is" and "as available". To the fullest extent the law allows, Mebot disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the Service will be uninterrupted, error-free, secure, or that output will be accurate.
13. Limitation of liability
To the fullest extent the law allows: (a) Mebot will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill; and (b) Mebot's total liability for all claims relating to the Service or these Terms is limited to the greater of the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or US $100. These limits apply whatever the legal theory, even if we were told the damage was possible. Some jurisdictions do not allow some of these limits, so they may not all apply to you.
14. Indemnity
You will defend and indemnify Mebot and its officers, employees and agents against third-party claims, and related losses and costs (including reasonable legal fees), arising from your content, your instructions to your Mebot (including calls, texts and meeting attendance), or your breach of these Terms or the law.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Service will be heard only in the state or federal courts located in Delaware, and you and Mebot consent to their jurisdiction. If you are a consumer in a country that gives you the right to bring claims in your local courts or under your local law, these Terms do not take that right away.
16. Changes to these Terms
We may update these Terms. We will post the new version here with a new "Last updated" date and, for material changes, tell account holders by email or in the Service at least 14 days before they take effect, unless the change is required by law or for security. If you keep using the Service after a change takes effect, you accept the new Terms. If you don't agree, stop using the Service and ask us to delete your account.
17. General
These Terms, with the Privacy Policy, are the whole agreement between you and Mebot about the Service. If a provision is unenforceable, the rest stays in effect. Our not enforcing a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them in a merger, acquisition or sale of assets. Neither of us is liable for delays caused by events beyond reasonable control. Notices to us go to support@mebot.ai.
